BLACKBURN LAWN & LANDSCAPE
(Hereinafter referred to as BLL)

DRIVEWAY SNOW BLOWING CONTRACT AND PROCEDURES SUMMARY
FOR 11/10/24 – 4/10/25

SNOW BLOWING (How & When):

Snow blowing will start when snow accumulation has reached 3 inches in a specific service area. Snow totals are determined by BLL supervisor. If the snow starts later in the morning, snow blowing routes will also start later. Contingent on enough accumulation, we typically start routes between 2:00AM – 3:00AM. With approximately 4-hour routes, our goal is to have all driveways cleared by 6:00AM – 7:00AM. Driveway snow blowing times are subject to: the time snow starts accumulating 3” or more, heavy snowfall rates, high vehicle traffic periods, and uncommon equipment breakdowns. Customer can NOT have an option of where they are placed in our routes, nor any specific guaranteed completion time windows. During extreme snowstorms, we will continue to snow blow during all time periods of the day except 10:00PM till 2:00AM. This contract does not include ANY hand shoveling in sidewalk areas or within 24” of garage doors. BLL does not provide de-icing on driveway surfaces and cannot be held liable for accidents or injuries. If BLL services your driveway, prior to the town servicing the street, we will return to remove the snow left behind in your driveway by the town. If the pile left behind from town is marginal, we will not remove it. BLL reserves the right of final determination of snow removal based on contract terms. Please call to solve problems and non-emergencies during the hours of 8:00AM to 5:00PM. Calls will be taken at other times for emergencies only.

DRIVEWAY MARKING:

BLL outlines all driveways with markers unless the ground has become too frozen. Our operators are instructed to clear your driveway approximately 12” from the markers to prevent property damage. BLL typically marks driveways by the 1st week in November. Driveways will not be marked without a signed and returned contract, paid in full. Driveway markers are the property of BLL and will be removed after April 10th. If a customer removes them early, please place them outside in an easy location for pickup, a fee could be charged for stakes not returned to BLL. If you remove your stakes before the contract has finished, we will not service your driveway during a late season storm. BLL cannot be held responsible for damage caused to vehicles from driveway markers.

HEAVY SNOW CONDITIONS:

During severe snow conditions where multiple visits are required, BLL operators may clear driveway quickly leaving some snow in driveway area temporally, allowing vehicle access through driveway. During our last visit after a storm has passed, we will clear ALL snow leaving a clean driveway area.

SNOW BUILD UP:

BLL snow blower operators are trained to clear your driveway starting approx. 24” from your garage door, to prevent damage to your house from our equipment. A ridge of snow/ice will form at the top of your driveway. Customers should shovel from garage door 24” or more to help alleviate this. This helps keep build up to a minimum and allows our operators to remove ALL snow from the driveway.

CARS/TRASH CONTAINERS IN DRIVEWAY:

Snow blowing around cars is very difficult. BLL will try to snow blow close to cars and obstacles (2-3’ away). Please leave any cars to one side or the top of the driveway to assist the operator efforts. Please do not leave trash containers in the driveway, operators will not move them and will only try to snow blow around them. Cars or trash cans blocking the driveway will cause operators to be unable to snow blow your driveway. If we’ve completed your route and left the area, there will be an extra charge to return for these circumstances, and a plow truck may be used (vs. snow blower) to clear the driveway.

ITEMS IN DRIVEWAY:

BLL will NOT be able to provide service to any driveway with a rubber street gutter guard at roads edge. These items must be removed prior to winter to prevent damage to our equipment. Any flowerpots or other personal items must be removed during contract dates. BLL will not pay damages caused to or by these items.

PROPERTY DAMAGE COVERED:

BLL will repair any lawn damage that occurs during the snow removal process. We use topsoil and grass seed (not sod) at the end of the season to make repairs. We will note any lawn repairs required when we remove our driveway markers. In the event we damage a light pole fixture or mailbox, BLL will repair or replace the item in a timeframe discussed with the property owner. We cannot guarantee the replacement item will be the same manufacture, model, color or shape. If the same item is no longer available, we will provide options of a similar value and style. Any property damage, caused by our operator, must be reported to BLL immediately.

PROPERTY DAMAGE NOT COVERED:

Pavement scratches, gouges, driveway cracking, pipes in or touching the side of driveway. As well as obstacles in the driveway that cannot be marked and or landscaping/obstacles hidden by snow when a customer has signed up after snow has fallen. Damage to paver blocks, stamp-crete, concrete driveways or sidewalks are not covered. BLL will not pay for any damages made to plants or trees from snow blowing. We recommend covering trees and plants before winter to help prevent any damage from snow loads etc. BLL does not pay for sealing or paving of driveways deemed damaged.

EQUIPMENT USED:

Farm tractors with specialized snowblowers outfitted with plastic cutting edges. A truck with a plastic snow blade may clear the bottom of the driveway if a town plow creates a large ridge of snow.

PAYMENT & TERMS:

Your signed contract/payment is required to begin service. All payment, collection and/or legal fees will be the responsibility of the customer. BLL reserves the right to cancel for non-payment or unworkable situations. If driveway size changes without notice, BLL reserves the right to change the total cost to the customer. In the event a contract must be dissolved for any reason, there will be a 20% administrative fee applied to refund. The remainder of the contract will be prorated at time of refund. If a customer becomes delinquent on invoices for other services outside of snow removal, snow removal services will be revoked until payment is made.

BLL reserves final determination of all terms, charges, and refunds. SNOW BLOWING DUE TO SNOWFALL IS COVERED UNDER CONTRACT, NOT SNOW THAT HAS BEEN PUT ON DRIVEWAY DUE TO ROOF SHOVELING OR REASONS OTHER THAN NATURAL SNOWFALL. EXTRA CHARGES NOT COVERED BY SEASONAL CONTRACT: Vehicles or trash containers blocking all/part of driveway when we have serviced, and customer calls us back for snow removal again. Customer requests to be snow blown with less than 3 inches of snow in the driveway. Snow blowing that is outside of the contract dates. Price will be determined by situation and provided to the customer before work is completed.
